Scope of application

The operator of these pages http://owllab.at takes the protection of your personal data very seriously. owl lab e.U. Mag. (FH) Anja Herberth offers her services in Austria in accordance with the Trade, Commerce and Industry Regulation Act (Gewerbeordnung) in the areas of management consulting, advertising and market communication.

We treat your personal data confidentially and in accordance with the legal data protection regulations and this privacy policy. In general, it is possible to use our website without providing personal data. Insofar as personal data (e.g. name, address or email addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties without your explicit consent.

We would like to point out that data transmission over the internet (e.g. when communicating by email) may have security gaps. It is not possible to provide seamless protection of data against access by third parties.

If you wish to use the (personalized) offers and services (e.g. email newsletter) offered on the website, we may require further information from you in order to provide these services and for billing purposes.

This data cannot be assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of illegal use.

Right to information, deletion, blocking

You have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing, as well as a right to correct, block or delete this data. You can revoke your consent to us to store your personal data and to use it to provide the respective services at any time. Furthermore, an objection to further use of data may result in you no longer being able to receive the services purchased and the respective service will be discontinued by us immediately. Your personal data will be deleted in this context and will no longer be available in our database.

to our external service providers who provide services such as website hosting, data analysis, infrastructure provision, IT services, customer service, email delivery services, auditing services and other similar services to enable them, as customers, to offer our services.

Surveys

From time to time, owl lab e.U. Mag. (FH) Anja Herberth may ask you to provide data as part of surveys. Participation in such surveys and the provision of data is voluntary. It is up to the person concerned to decide whether they wish to provide the relevant information and consent to the collection and processing of this data. The survey data is always encrypted. The information you provide in the interview is recorded and processed and evaluated anonymously and separately from your contact data. Your contact data is stored separately from your answers for a period of time so that we can conduct random checks at a later point in time to ensure that the interview was conducted properly by our employees. It is therefore possible that an employee of our communications consultancy will contact you again by telephone for internal verification purposes.

In rare cases, you will be asked whether we may forward your information and/or data to the client. We may only do so if you have specifically given your permission to do so.

Use of the site by minors

The site is not directed at minors and we ask that minors do not provide any personal data through the site; participation in surveys is only possible from the age of majority.

Objection to advertising e-mails

We hereby object to the use of the contact data published in accordance with the imprint obligation to send unsolicited advertising and information material. The site operators expressly reserve the right to take legal action in the event of unsolicited advertising information being sent, for example by spam e-mails.

Violation of business or trade secrets and misuse of entrusted templates according to § 11 UWG

(1) Any employee of a company who, during the term of the employment relationship, discloses to others for the purposes of competition business or trade secrets that have been entrusted or otherwise made accessible to him by virtue of the employment relationship, shall be punishable by the court with a prison sentence of up to three months or a fine of up to 180 daily rates. (BGBl. Nr. 120/1980, Art. I Z 6)

(2) The same penalty shall be imposed on anyone who, for the purposes of competition, makes unauthorized use of or discloses to others any business or trade secrets of which they have gained knowledge through one of the disclosures referred to in subsection 1 or through their own action in violation of the law or good morals.

(3) Prosecution shall only take place at the request of the injured party.

(FH) Anja Herberth are subject to the confidentiality requirements of the Telecommunications Act and the confidentiality obligations of the Data Protection Act. Content data may be stored if this is absolutely necessary for billing or processing the contractual relationship. However, content data is not stored beyond the minimum technically necessary and is never evaluated.

Collection, processing and use of data

Security of processing pursuant to Art. 32 (4) GDPR

The controller and the processor shall take steps to ensure that natural persons acting under their authority who have access to personal data do not process such data except on instructions from the controller, unless they are required to do so by Union or Member State law.

The controller and the processor must guarantee an appropriate level of protection by means of suitable technical and organizational measures; this can be demonstrated, for example, by approved codes of conduct (Art. 40) or approved certification procedures (Art. 42).

Data secrecy according to § 6 DSG

The controller, the processor and their employees – that is, workers (employees) and persons in an employee-like relationship, e.g. interns – have to keep secret personal data from data processing that they have been entrusted with or have gained access to solely on the basis of their professional occupation, without prejudice to other statutory confidentiality obligations, unless there is a legally permissible reason for transmitting the personal data that has been entrusted or accessed (data secrecy).
